This Privacy Policy explains how ShiftScale Digital LLC (“ShiftScale,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards information in connection with the DealerTasker platform, our website at dealertasker.ai, and related services (collectively, the “Services”).

By using the Services, you agree to this Privacy Policy. If you do not agree, do not use the Services.

1. Who this policy covers

The Services are provided to automotive dealerships and similar businesses (“Dealers,” “Customers,” “you”). This policy addresses three kinds of individuals:

  • Dealer personnel — staff who use the platform.
  • Consumers — a Dealer’s customers and prospects whose information is processed through the Services on the Dealer’s behalf.
  • Website visitors — anyone who visits our public website.

For consumer information processed on a Dealer’s behalf, the Dealer is the controller of that information and is responsible for having the appropriate rights, notices, and consents. ShiftScale acts as a service provider / processor and only processes that information to provide the Services under our agreement with the Dealer. This Privacy Policy governs our own practices; a consumer’s relationship is primarily with the Dealer they interacted with.

2. Information we collect

a. Information you provide. Account and contact details (name, business email, phone), business information, billing and payment details, support communications, and content you submit (e.g., messages, notes, configuration).

b. Consumer information processed on a Dealer’s behalf. To deliver the Services, we process consumer records supplied by the Dealer or drawn, with the Dealer’s authorization, from the Dealer’s connected business systems. This may include contact details, vehicle information, service and sales history, appointment records, and communications history (calls, texts, emails, and chat).

c. Information from connected dealership systems. With the Dealer’s authorization — granted through the Dealer’s own accounts and, where applicable, the relevant integration marketplace — we access data from third-party dealership management, CRM, scheduling, inventory, and communications systems. We access only the data fields necessary to provide the Services, and we use that data solely to provide the Services to that Dealer. We do not sell it and do not use it for our own independent purposes. (See also our Data Processing & Security page.)

d. Information collected automatically. Device and usage data, log data, IP address, and cookie/similar-technology data when you visit our website (see our Cookie Policy).

We do not knowingly collect information from children under 13 (or under 16 where applicable). The Services are for business use and are not directed to children.

3. How we use information

We use information to:

  • provide, operate, maintain, and improve the Services;
  • authenticate users and secure accounts;
  • process transactions and send related administrative communications;
  • deliver, route, and analyze communications (calls, texts, emails, chat) that a Dealer sends to its consumers through the Services;
  • generate reporting and analytics for the Dealer;
  • provide customer support;
  • detect, prevent, and address fraud, abuse, security, and technical issues; and
  • comply with legal obligations and enforce our agreements.

We use consumer information only to provide the Services to the applicable Dealer, and as otherwise directed by that Dealer, consistent with applicable law.

4. How we share information

We share information only as follows:

  • With service providers / sub-processors that perform functions on our behalf — for example, cloud hosting and infrastructure, communications infrastructure (voice/SMS/email delivery), payment processing, and analytics. These providers are permitted to use the information only to perform services for us and are bound by confidentiality and data-protection obligations. We describe them by category rather than name; a categorized sub-processor summary is available on request where required.
  • With connected dealership systems, at the Dealer’s direction, to read or write data as needed to provide the Services.
  • With the applicable Dealer, whose consumer data we process.
  • For legal reasons — to comply with law, regulation, legal process, or enforceable governmental request; to enforce our terms; or to protect the rights, property, or safety of ShiftScale, our users, or others.
  • In a business transfer — in connection with a merger, acquisition, financing, or sale of assets, subject to this policy.

We do not sell personal information, and we do not “share” it for cross-context behavioral advertising as those terms are defined under applicable U.S. state privacy laws.

5. Communications, calls, and text messages

The Services enable Dealers to communicate with consumers by phone, text message, email, and chat. Calls and messages may be recorded, transcribed, and analyzed to provide and improve the Services, where permitted by law and subject to the Dealer’s notices and consents. Text-message practices — including how consumers opt in, opt out (reply STOP), and get help (reply HELP) — are described in our SMS / Text Messaging Terms.

6. Data retention

We retain information for as long as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Consumer information processed on a Dealer’s behalf is retained according to our agreement with that Dealer and is deleted or returned on termination as described there, subject to legal retention requirements and routine backups.

7. Security

We maintain administrative, technical, and organizational safeguards designed to protect information, including encryption in transit and at rest, role-based access controls, per-Dealer data isolation, and hosting with reputable infrastructure providers in the United States. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. See our Data Processing & Security page for more detail.

8. Your choices and rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or port certain personal information, to opt out of certain processing, and to appeal a decision about your request.

  • Website visitors and Dealer personnel may contact us at support@shiftscaledigital.com to exercise available rights.
  • Consumers whose information is processed on a Dealer’s behalf should direct requests to the Dealer they interacted with; where we receive such a request directly, we will refer it to, or act at the direction of, that Dealer.

We will verify requests and respond within the timeframes required by applicable law. We will not discriminate against you for exercising your rights.

9. U.S. state privacy disclosures

Where applicable state laws (such as those in California and other states) grant rights regarding personal information, ShiftScale honors those rights as described above. Categories of information, purposes of use, and disclosure practices are described in Sections 2–4. As stated, we do not sell personal information or share it for cross-context behavioral advertising.

10. International users

The Services are operated in the United States and intended for U.S.-based businesses. If you access the Services from outside the United States, you understand that information may be processed in the United States.

11. Third-party links

The Services may link to third-party websites or services we do not control. Their privacy practices are governed by their own policies.

12. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be indicated by updating the “Last updated” date and, where appropriate, by additional notice. Continued use of the Services after changes take effect constitutes acceptance.
