SMS / Text Messaging Terms & Consent

These SMS Terms describe how text messaging works in connection with the DealerTasker platform operated by ShiftScale Digital LLC (“ShiftScale,” “we,” “us”). They apply both to (a) messages ShiftScale may send you about the Services, and (b) the messaging capabilities ShiftScale provides to dealerships (“Dealers”) for communicating with their own customers.
Note for Dealers: When you use the Services to text your customers, you are the sender and are responsible for obtaining proper consent and complying with all applicable laws and carrier requirements (including the TCPA, CTIA guidelines, and 10DLC/A2P registration requirements). ShiftScale provides the tooling; you control who is messaged, when, and with what content.
1. Consent to receive messages
By providing a mobile number and opting in, you agree to receive text messages at that number. Consent may be obtained through a website form, a written or verbal request, an existing business relationship where permitted, or another lawful opt-in method. Consent is not a condition of purchase.
Message types may include appointment reminders and confirmations, service and account notifications, and marketing or promotional messages where you have opted in to those.
2. Message frequency
Message frequency varies based on your interactions and the programs you opt into. Recurring messages may be sent.
3. Message and data rates
Message and data rates may apply, depending on your mobile carrier and plan. ShiftScale and the Dealer are not responsible for charges from your carrier.
4. How to opt out — reply STOP
You can cancel messages at any time by replying STOP to any message. After you send STOP, you will receive a one-time confirmation that you have been unsubscribed, and you will not receive further messages from that program unless you opt back in. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT.

6. Supported carriers
Messaging is supported on major U.S. wireless carriers, but delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages.
7. Changes to your mobile number
If you change or deactivate your mobile number, you agree to notify us or the Dealer so messages are not sent to a reassigned number.
8. Privacy
Information collected in connection with messaging is handled per our Privacy Policy. Mobile opt-in data and consent records are used to operate the messaging program and are not sold or shared with third parties for their own marketing. Message content may be processed to deliver, route, and analyze communications as described in the Privacy Policy.
9. Dealer responsibilities (messaging compliance)
If you are a Dealer using the Services to message consumers, you agree that you will:
- obtain and maintain records of proper consent before messaging;
- honor opt-outs promptly (the platform provides automatic STOP/HELP handling, but you remain responsible for compliance);
- send messages only within permitted hours and in compliance with applicable law;
- complete and maintain any required brand/campaign (10DLC/A2P) registration; and
- not send prohibited content (e.g., messages in restricted categories) in violation of carrier rules or law.
